1) ELIGIBILITY: The Sprint Halloween Photo Contest (the “Contest”) is open only to legal United States residents of the 50 United States or District of Columbia or Puerto Rico who are eighteen (18) years of age or older or the applicable age of majority in his/her jurisdiction of residence. Employees of Sprint Communications Company L.P., Blackberry, Syncapse, Millennium Communications, Marden-Kane, Inc., advertising and promotion agencies or other companies associated with the promotion of the Contest (collectively defined as the “Contest Entities”), as well as the immediate family (spouse, parents, siblings, and children) and household members of each such employee are not eligible to enter or win a prize. The Contest is subject to federal, state, and local laws and regulations. Void where prohibited by law.

2) SPONSOR: The Contest is sponsored by Sprint Communications Company L.P. (the “Sponsor”) located at 619 A Klumpf Avenue, Waterloo, ON N2V 1K2. The Contest Administrator is Marden-Kane, Inc., located at 1055 Franklin Avenue, Suite 300, Garden City, NY 11530.

3) AGREEMENT TO OFFICIAL RULES: Participation in the Contest constitutes entrant’s full and unconditional agreement to and acceptance of these Official Rules and the decisions of the Sponsor, which are final and binding. Winning a prize is contingent upon fulfilling all requirements set forth herein.

4) SUBMISSION PERIOD: The Contest begins on October 22, 2012 at 12:00:00pm Eastern Time (“ET”) and ends on November 1, 2012 at 11:59:59pm ET (the “Submission Period”). During the Contest Period there are a series of contest-related events that start and end on or about the dates and times noted below. Entries that are submitted before or after the Entry Period will be disqualified.

Mobile Site: Access the Sprint Contest application at http://ps.syncapse.com/app/rim-contest-sprint [1] complete the registration form by providing the information required; [2] Upload a digital photo that depicts your favorite Halloween costume; [3] write your brief 50 character description of the photo in the space provided (collectively an “entry submission” or “entry”); and [4] Click the submit button. Standard rates will apply according the terms and conditions of Entrant’s service agreement with his/her wireless carrier for participation in this Contest via a wireless mobile device (which may only be available via participating wireless carriers) and/or download or transmission of data via his/her wireless mobile device. Other charges may apply (such as normal airtime and carrier charges) and may appear on the entrant’s mobile phone bill or be deducted from the entrant’s prepaid account balance. ENTRY SUBMISSION REQUIREMENTS:
Entry submission must be created solely by the Entrant.
MUST be no more than 50 characters.
MUST be in the English language.
MUST be in .jpg, .jpeg, .gif or .bmp format.
MUST be no larger than 10 MB in file size.
MUST be of satisfactory quality (i.e., brightness, focus, lack of clarity (can not determine what the costumes are), etc.), as determined by Sponsors in its sole discretion.

ENTRY TERMS: By submitting an entry, Entrant agrees to comply with the Contest Official Rules. Additionally, Entrant warrants that his/her, entry submission, and all elements thereof satisfy contest Official Rules, by warranting the entry submission in this contest:

By entering the contest, each Entrant represents and warrants that he or she has obtained all of the rights, licenses, and permissions from the additional person who appeared in or helped to create the entry. If Sponsor and/or Administrator determines in its sole discretion that an Entrant has breached a representation or warranty, the entry will be disqualified.

Any entries attempted through the use of agencies or robotic, repetitive, automatic, programmed, or similar methods will be void. All completed entries become the property of Sponsor and will not be returned. All late, lost, or incomplete entries are not considered valid entries.

6) JUDGING AND PURBLIC VOTING TO DETERMINE TWO GRAND PRIZE WINNERS

BLACKBERRY FROM SPRINT WINNER:
A panel of judges consisting of the Sponsor and/or Administrator and their representatives (the “panel”) will score each eligible Entrant’s submission based on the following Judging Criteria (the “Judging Criteria”):

Based on the panel’s scores, the highest scoring entry will be deemed the Grand Prize winner, pending verification of eligibility.

FAN FAVORITE PUBLIC VOTING WINNER:
At the commencement of the Public Voting Period set forth above, all qualified entry submissions will be posted for public voting on the Facebook application at http://www.facebook.com/BlackberrySprint. You can vote on as many photos as you like, but there is a llimit of one (1) vote per photo. Any participant offering or using, or attempting to use a “cheat,” payment, or other incentive, or any other means to obtain votes will be disqualified in Sponsor’s sole discretion. Persons voting are encouraged to use the Judging Criteria to evaluate the photo submissions. Subsequent votes in excess of stated maximum by a single person will be disqualified. To avoid voter fraud, each person who votes will need to provide their date of birth, first name and an e-mail address in order to have their vote counted. This data will not be used for any purpose other than to eliminate voter fraud and will not be stored or used for any purpose after the Public Voting Period has concluded. To vote, you must be a legal US resident 18 years of age or older. The use of any automated launching or entry software or any other mechanical or electronic means that permits contest Website visitors to vote repeatedly is prohibited. Employees, officers, directors, and immediate family members of the Sponsor and its respective parent company, affiliated and subsidiary companies, advertising and promotion agencies, legal and financial advisors, and any and all other companies associated with this contest (collectively referred to as the “contest entities”) are not eligible to participate in the Public Voting Period. No person may vote by proxy for any other person. Neither you nor anyone acting on your behalf may offer consideration, services, or anything of value in an attempt to further your position in the Contest. The use of any automated launching or entry software or any other mechanical or electronic means that permits. Website visitors to vote repeatedly is prohibited and all votes cast by such automated means will be disqualified.  The entry with the most votes will be deemed the other Grand Prize winner, pending verification of eligibility.

In the event of a tie in any part of the Blackberry from Sprint judging or the Fan Favorite public voting portions of the Contest, all tied entries will be re-judged by an additional judge selected by the Sponsor who will break the tie using the Judging Criteria. The judges' decisions are final and binding in all matters relating to this contest.

7) WINNER NOTIFICATION/REQUIREMENTS OF POTENTIAL WINNERS:

On or about November 9, 2012, the Contest Administrator will notify the potential Grand Prize Winners via email by the email address provided on the entry form. If a Potential Winner cannot be contacted, if message is returned as undeliverable, or does not respond within five (5) days after the first attempt to contact him/her, the Contest Administrator may select an alternate Potential Winner in his/her place at random from the remaining entries. Potential Grand Prize Winners will be required to complete and sign an Affidavit of Eligibility and Liability Release; where legal, a Publicity Release and an Entrant Agreement and Release (collectively the “Releases”); and IRS Form W-9, all of which must be returned within the required time frame or the prize will be forfeited and the next highest scoring entry will move up and notified time permitting and at the sole discretion of the Sponsor. Potential Grand Prize Winners will also be required to furnish their social security numbers that will be used only for the purpose of reporting the Grand Prize Winner’s prize earnings to the Internal Revenue Service, as required by law. If any information found in the Releases does not comply with the Official Rules, he/she will be disqualified and the next highest scoring entry will move up and notified time permitting and at the sole discretion of the Sponsor. Decisions are final and binding in the Sponsors sole discretion.

Once cleared by the Sponsor and Contest Administrator, the Grand Prize Winners grant the Sponsor the absolute right and permission to use name, address, likeness, voice, or opinions in any and all advertising and promotional materials, or to refrain from doing so, in any manner or media whatsoever, worldwide, for advertising and promotional purposes without notice and without further compensation. Winners understand that he/she shall have no right of approval, no claim to any compensation, and no claim arising out of the use, alteration, distortion, or illusionary effect or use in any composite form of  name, address, likeness, voice, or opinions.

8) PRIZES:

Prizes: Two (2) Grand Prize Winners will receive $5,000 each (awarded in the form of a check). Value of each Grand Prize is $5,000. Total Value of all prizes is $10,000.00. The prizes are not transferable or refundable and must be accepted as awarded. No substitution may be made, except by the Sponsor, who reserves the right to substitute a prize (or component thereof) with another prize (or component thereof) of equal or greater value if the prize is not available for any reason as determined by the Sponsor in its sole discretion. The Prize Winners are responsible for any and all other costs and expenses not listed above. The Grand Prize will be reported as income to the Grand Prize Winners and the Grand Prize Winners will be responsible for all taxes associated with the receipt of the prize. Any prize details not specified above will be determined by the Sponsor in its sole discretion.

9) PRIVACY AND PUBLICITY:

All information submitted by entrants in the Contest will be treated according to Sprint’s Privacy Policy, available at www.sprint.com/privacy. Except where prohibited, participation in the Contest constitutes an entrant’s consent to the Contest Entities use of his/her name, likeness, voice, opinions, photo(s), biographical information, and state of residence for promotional purposes in any media without further payment or consideration.

10) GENERAL CONDITIONS:

In the event that the operation, security, or administration of the Contest is impaired in any way for any reason, including, but not limited to fraud, virus, or other technical problem, the Sponsor may, in its sole discretion, either (a) suspend the Contest to address the impairment and then resume the Contest in a manner that best conforms to the spirit of these Official Rules or (b) award the prizes at random from among the eligible entries received up to the time of the impairment. The Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Failure by the Sponsor to enforce any provision of these Official Rules shall not constitute a waiver of that provision. In the event of a dispute as to any online entry, the authorized account holder of the email address used to enter will be deemed to be the participant. The “authorized account holder” is the natural person who is assigned to an email address by an Internet access provider, online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted email address.

11) RELEASE AND LIMITATIONS OF LIABILITY:

By participating in the Contest, entrants agree to release and hold harmless the Contest Entities and their parent companies, officers, directors, employees, and agents (the “Released Parties”) from and against any claim or cause of action arising out of participation in the Contest or receipt or use of any prize, including, but not limited to: (a) any technical errors that may prevent an entrant from submitting an entry; (b) unauthorized human intervention in the Contest; (c) printing errors; (d) lost, late, postage-due, misdirected, or undeliverable mail; (e) errors in the administration of the Contest or the processing of entries; or (f) injury, death, or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest or receipt of any prize. Entrant further agrees that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the Contest, and in no event shall the Released Parties be liable for attorney’s fees. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.

12) DISPUTES:

Except where prohibited, entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the Province of Ontario. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the Province of Ontario, without giving effect to any choice of law or conflict of law rules (whether of the Province of Ontario or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the Province of Ontario.

13) CONTEST RESULTS:
